Komet Sale Alert — Terms of Use

These terms apply to the Komet Sale Alert app and its web pages ("Komet"), provided by Ecom Applications Pty Ltd, Western Australia ("we", "us"). By using Komet you agree to them. If you do not agree, please do not use Komet.

What Komet does

Komet watches public information from retailers — their product listings and their sale announcements — and tells you when a brand you follow starts a sale or an item you follow drops in price. Komet is free. You must be 13 or older to use it.

We are independent of the retailers

Komet is not affiliated with, endorsed by or sponsored by the brands and retailers shown in it, unless we say so. Brand names, logos and product images belong to their owners and are shown only to identify the retailer and its products. When you tap through to a store you are dealing with that retailer: your purchase, payment, delivery, returns and any dispute are between you and them, under their terms.

Prices, discounts and alerts

Prices, "was"/original prices, percentages off, sizes, stock and sale dates come from the retailer's own listings and announcements. We repeat them; we do not set or verify them, and they can change or be withdrawn at any time. Always check the price on the retailer's site before you buy.
A percentage off is calculated from the original price the retailer lists for that item.
Prices are shown in Australian dollars as listed for Australian shoppers.
We check prices several times a day and look for sale announcements through the day. Alerts usually arrive the same day, during daytime hours. We do not promise that an alert will be instant, that we will catch every sale or price drop, or that an item will still be available or at that price when you get there.
If we find an alert was wrong we will correct it as soon as we reasonably can.

Links and commissions

Komet links to retailers' websites, which we do not control. We may earn a commission from a retailer when you buy after tapping a link in Komet. Where a link earns us a commission we will say so in the app. It never changes the price you pay, and brands cannot pay to have a sale alert sent that is not a genuine sale.

Using Komet fairly

Please do not misuse Komet: do not attempt to access other people's data, interfere with the service, copy our data in bulk, or use automated means to access it. We may suspend access for misuse. Wishlist share links are visible to anyone who has the link.

Our content

The Komet name, app, design and the way we organise information belong to us. You may use Komet for your own personal, non-commercial shopping.

Our liability

Nothing in these terms limits your rights under the Australian Consumer Law, including the consumer guarantees, which cannot be excluded. Subject to those rights: Komet is provided "as is"; we do not guarantee it will be uninterrupted or error-free; and, to the extent the law allows, we are not liable for loss arising from a missed, late or incorrect alert or price, from a retailer's acts or omissions, or from your dealings with a retailer. Where our liability cannot be excluded but can be limited, it is limited to supplying the service again.

Privacy

Our privacy policy explains what we collect and how to delete it.

Changes and ending

We may change Komet or these terms; we will update this page and its date. You can stop using Komet at any time and erase your data from inside the app (Explore → ? → Delete my data).

Governing law

These terms are governed by the laws of Western Australia, and the courts of Western Australia have jurisdiction.
